This license agreement is made between OakStock Music Productions (oakstockmusic.com - a division of OakStream Music Productions) and you (the purchaser) of an adjusted track or a newly created music track or score.

You are granted a single lifetime exclusive license upon purchase of an adjusted track or a newly created music track or score.

Agreeing to the terms of this license allows you to use the music track in synchronization within your audio or audiovisual production(s).

This license is exclusive, meaning that the track will not be sold or given away to any other person or organization. You are not permitted to transfer the license to any other individual, organization, or company. This means that purchased adjusted track(s) through or a newly created music track or score from OakStock Music Productions (oakstockmusic.com) may not be re-sold, shared, or transfered in any other way as an independent stand-alone track.

Productions created by you, the purchaser, using music from OakStock Music Productions (oakstockmusic.com) may be marketed and distributed worldwide.

Purchased music tracks may be looped, cut, or otherwise altered to fit your needs; however, no additional musical sounds or instruments (including vocals with the exception of voice-overs) may be added without explicit permission. Productions that do not contain any visual elements must have voice-overs at a minimum of 10 second intervals.

Music purchased from OakStock Music Productions may not be used in conjunction or synchronization with any materials that are illegal or deemed pornographic in nature.

OakStock Music Productions, and all copyright relating to all music and sounds in the oakstockmusic.com royalty-free music track library, are owned by Kirk A. Smith, unless otherwise stated, including adjusted track(s) or a newly created music track or score.

Indemnification

You, the purchaser, agree to hold harmless, indemnify, and defend OakStock Music Productions, from and against any losses, damages, fines, or expenses (including attorney's fees and costs) arising out of or relating to any claims that you, the purchaser, have copied any materials in connection with your production in violation of another party's rights or in violation of any law. OakStock Music Productions shall not be responsible for any import and export duties or other claims arising from such activities related to your production.

Public Performance Rights

This license agreement does not cover public performance rights. You are required to fill out a cue sheet if your production using music from OakStock Music Productions is to be used for public broadcast (including but not limited to television, radio, film, and theatrical productions). Organizations such as ASCAP and BMI in the United States and SOCAN in Canada are responsible for collecting royalties that are due to the appropriate composers. A cue sheet must be submitted in a timely fashion to us and we will forward the information to SOCAN. This does not cost you, the producer, any extra fees, as these royalties are collected and distributed by these agencies.
